Ameriquest Settles Massive Mortgage Fraud Claim
They’ve been lending mortgages to hundreds of thousands of American homebuyers with bad credit for years—that is, until the lawsuits claiming predatory lending practices started to pile up. Yesterday, Ameriquest Mortgage, one of the largest lenders in the country, settled multi-million dollar lawsuits alleging mortgage fraud spanning 49 U.S. states.
From today’s online edition of the The San Francisco Chronicle:
Ameriquest Mortgage, the nation’s largest subprime mortgage company, settled predatory lending allegations by 49 states on Monday, agreeing to pay $295 million in restitution and clean up its lending practices. The agreement, which included an additional $30 million to reimburse states for their legal fees, was the second-largest predatory lending settlement, after a $484 million agreement reached in 2002 with Household Finance Corp.
In a conference call, several state attorneys general said Monday they found evidence that Ameriquest had engaged in a wide variety of unethical and possibly illegal sales tactics. Before 2003, they found many instances where Ameriquest customers ended up with more expensive loans than sales reps had promised. Those abuses abated after Ameriquest changed some sales practices in 2003, but others persisted, and in some cases, worsened, regulators said. Some Ameriquest sales reps allegedly inflated borrowers’ incomes so they could take out a bigger loan, often one they couldn’t afford to repay.
At issue was whether Ameriquest turned the American dream of homeownership into a full-on nightmare by using deceitful and deceptive practices to bilk borrowers desperate for better deals on debt. Yesterday’s settlement is a strong indication that Ameriquest–the nation’s leading sub-prime lender–indeed misled consumers as to key terms like interest rates and prepayment penalties, and inflated their incomes levels and home appraisals, all of which lead to higher loans than they could afford and often caused foreclosures and an onslaught of related financial disasters.
At the end of the day, the settlement is as strong an indication as any that Ameriquest pressured appraisers to inflate property values so borrowers could get bigger loans, imposed upfront fees without reducing interest rates as promised, and told borrowers to ignore written information about interest rates because they would give them lower rates later. The company is also alleged to have given them higher interest rates instead. Ameriquest also assured some borrowers that their loans would have no prepayment penalties, then inserted such payments into the final loan documents; delayed the time period between the loan closing and the funding; and misrepresented fees and costs.
Under the terms of the agreement, Ameriquest will pay $295 million in restitution to consumers nationwide and another $30 million to the 49 states and the District of Columbia for attorneys’ fees, costs, consumer education and enforcement programs.
The settlement includes Ameriquest’s holding company, ACC Capital Holding Corporation, and its subsidiaries, Ameriquest Mortgage Company, Town & Country Credit Corporation and AMC Mortgage Services, Inc., formally known as Bedford Home Loan. Ameriquest itself is based in Orange, Cal., near Los Angeles.



When can we, the consumers/customers, expect to see the compensation mentioned in the statement below regarding Ameriquest’s restitution ?
“Under the terms of the agreement, Ameriquest will pay $295 million in restitution to consumers nationwide” .
I understand the ruling occurred in January ‘06. It is now August ‘06. I think that’s enough time for them to get their act together.

My husband and I are homeowners in New Jersey who also are feeling the after shocks of Ameriquest’s fraudulent mortgage lending practices. We were not, however, until now aware of any class action lawsuits that we could have joined in. Is it too late to join in? Any information/suggestions would be appreciated. With what we are going through right now with Ameriquest we feel we deserve some compensation from them.

This organization is almost completely corrupt. Their tactics are so rampant that they are as common as answering the phone. Unfortunately we only know a small portion of their illegal activity and cleverly camouflaged tactics to deceive. Remedies are sparse and cooperation from AMC, Ameriquest or their bottom-of-the-barrell associate EMC Mortgage are almost nonexistent other than litigation. i go an equity loan last july 2005, and the appraisal came in at 81,000, Now i want to sell the home and i am very upside down on the loan. i contacted the amc legal department and they want to do a short term pay off. but they appraised my home again last week and they say it came in at 70,000. an 11,000 drop in one year. give me a break!!!!!i want to pursue the issue with legal help but i dont know where to turn to,, can some one help

I also got an equity loan in June, 2004 and they appraised the home at 70,000 and it is no where near that much other companies say. The loan was an adjustable rate but it has almost tripled since 2004 and I don’t know what to do. There are some other issues about the whole situation that I would like to pursue but do not where to go to get help. I think they took advantage of me because I was a recent widow. Any information would greatly be appreciated.

We have been fighting these idiots for several years now and each month they will come up with some new charge that if we don’t pay it they will foreclose. We just got a letter of intent to foreclose over a payment 4 months ago they say did not clear yet I have bank statements saying it most certainly did. They want me to fax this information and a statement of what I think caused this. They have stolen from us for years now and we are in a bankruptcy so our hands are some what tied.

How do I get my name added to the lawsuit. Falsified income information for me on loan documents ended up in a foreclosure in June of 2006. AMC sent us notification eligible for lawsuit money but can’t since foreclosure happened. Any information would be helpful.

I’m recently hearing about this lawsuit because i,m in a forebance contract with them when every month they are sending me letter of foreclosure pecending when they are wired the money everymonth. Why were all their customer noifty of this lawsuit maybe we all could have took part in this. So how do we get help for our situation with this. Should I start looking for a new Mortage loan company.

This is a true story I have been asking for help and pleading for help for 11, months from Equifax and Experian, TransUnon. I Paid for six of there online monitor’s services to help me fix there errors and inaccuracy on my credit report. I never received the support that I was entitled to by the customer service staff nor did I get help. Alternatively, support, for a paying customer your system did not work.
I have been harass first by Consumers affair department to stop sending letters to the Corporate office and .after talking to the woman first she said they did every thing that they had to do. .I told her that not true, she said it the creditors are the one reporting the information on my credit report; Ok But the rulebook said you have 30 to 45. To investigate or it must deleted or correct that in the rulebook Right .So I said to her that wrong she said I did not say. What I am trying to say that the law. .If you want to hear the recording it should be there to see if I am telling the true about the talk we had.

I have been put in this situation of hardship. On top of that, 80 Inquire were added to my credit report that .Equifax deleted and Experian deleted about 60. TransUnon deleted the same. I worked there for 2 months and what a joke. Went to lunch and didn’t come back.
If your getting harrasing phone collection calls when your only a few days past due send them by fax this letter
“In accordent of the FAIR DEBT COLLECT ACT I am requesting that you not contact me by phone and that all coorespondence is to be done through the U.S. Mail”
By law they will not call you and they won’t.
I have been in the Mortgage business for 15 years. They were the absolute worse I have even seen.

How is it possible for a company to do so much harm to so may citizens and get away with it. My personal experience I purchased a home in florida and made my first payment. Therafter unfortunally both my husband and I lost our jobs. Immediately I attempted to arrange to make payment arrangements, however they never helped me forcing me into a forcelosure. To make matters worst the insurance company (citizens) canceld the policy because the information they received was incorrect therefore, AMC forced $3,000.00 montly policy to my mortage and did not nofity me until I owed about 9,000.00. How is it possbile with all the law suits complaints etc … for this company to continue to be in business . I am a great beliver in GOD and I hope someday there will be some justice made.

Well, I am very saddened to hear that all of you have so many negative comments to make about this company. Yes, Ameriquest was involved in the lawsuite that covered 49 states. Unfortunately, due to the industry demands, individuals have taken the lessor of the “do the right thing” road. It is very unfortunate how those individual employees have cast such a horrific shadow on a company. Yes, the company untimately has employed those people, however I have not read any comments about the indiviuals whom assisted in the “fraudulent acts” themselves. Where is the responsibility? I have been in the industry for many years, 12 to be exact. And I have seen many companies fall about because of the neglegance, ignorance and arrogance of individuals that are working with the High Powered mortgage companies.
Please do not misunderstand my point of view. I am in no way shape or form discounting the company for the acts that “were” committed. However, because this company is one of the leading lenders in the subprime market, they are bound to have legallities that cover this spectrum.
I wish all of you all the luck and comfort. I just wish they would prosecute those individuals rather than shame the company as a whole.

SO you all think you have it bad; Ameriquest inflated our property value; committed fraud; and in the end sought foreclosure judgment; and they accomplished this; and once I found out that there was an avenue to contest what happened to me; I took it; now the judgment just mysteriously disappeared and has gone away; but I have proof it did exist; by my credit report. So damage has been done and I recommend everyone contact a legal malpractice attorney; because this isn’t over with in any form or fashion…

Ameriquest… Where do i start. Hmm how about paying intrest and payments on money that they still have. I took a morgatge loan out with ameriquest and i can see the downward spirle begining what can i do to fix this? Part of the stipulations to our loan was our bad credit was to be paid off. Ameriquest made payment arangments for the 15th of the month and didnt fund the loan till the 25th of the month. Well everyone knows the rest of the story now the creditors want more money. a long story short they made a real mess out of my loan and they still have some checks that were double cut and even a check for a debt that was not mine they now refuse to refund the roughly $6000.00 to the loan or recut the checks to me or recut them twords one of our other debts so essentially totally screwed up our loan, our credit, our finances, and our plans for home repairs, and bassically our future. Can someone point me in the right direction and hopefully keep me from falling into the blackhole. Thanks!

I am writing this letter with the hopes that there is someone out there who can help me. On December 20, 2006 my home is in foreclosure and I am running out of time. In 83 days, my home is going on sale I need help. I am a single father, raising two boys. I have worked hard my whole life, and have always paid my bills on time. I own my home and am very proud of that. Now everything that I have worked so hard for might be taken away from me and I don’t know how to stop it. Here is my story.
I purchased my home in 1997. I lived here with my wife and two boys. Five years ago my wife and I divorced and I bought out her half of the house, so I could live here with my boys. I have never been late on a single house payment. In November, 2005 I was injured and was unable to work. I was self employed and did not have health insurance. In January 2006, while recovering, I decided to refinance my home. This is when my nightmare began.
When I checked my credit report, I found that there was nearly 50 errors on it. There were several accounts that had been paid in full that still showed a remaining balance. It also showed a 30 day late on my house payment, and 38 inquiries which were adversely affecting my score. I immediately contacted the three credit bureaus, Equifax, Experian and Trans Union. I provided all of the necessary documents to the credit bureaus, which included letters of confirmation from the creditors stating that the accounts were paid in full, along with copies of checks. I called day after day, week after week. I faxed, mailed & e-mailed. I have written about 200 letters or more. I was asking for help and pleading for help for 11, months. I never received the support that I was entitled to by the customer service staff nor did I get help.
In addition, I paid for the on-line monitoring services (listed below) from all three credit bureaus to help fix and correct the errors and inaccuracies that reported in my credit report and their products failed and their services and the system failed.

I did not get the support or help that was entitled to by the customer services staff. My accounts were not properly handled and my credit score was not correct.
We as consumers have the right to have the correct information reported on our credit report. By law, all inaccurate information must be removed within 30-45 days. This did not happen. I was mistreated by all three credit bureaus, and now I am scared that I might lose my home. Due to my incorrect credit score, I was unable to refinance my home, with a monthly payment that I can afford in the first of the year.
In Mar 2006, I put trust in my broker, Ms. Shelly Poe, Pinnacle Finance to help me with refinancing my home. I trusted her because she also helped me with my previous loan. She assured me that my monthly payment was going to be reduced to $1800.00, and I would receive approximately $30,000. I was to sign on Oct 11 2006. At the last minute, she called and informed me that the best she could do was raising my house payment to over $4,000.00 per month and get only $6,000.00 cash back. Ms. Poe knew my situation with my credit score, and that I was becoming delinquent in my mortgage payments. For months, she led me to believe that she was going to help me, and then dropped me at the last minute, leaving me with nothing to work with. As a homeowner today, we put our trust into the brokers and lenders to be honest and upfront. After all, they are the professionals, and we rely on them to do the right thing.
She explained to me that this would only be a “band-aid loan”. She promised me that she would assist me in correcting the errors on my credit report, to raise my credit score, then get a loan in which my payments were reduced by half. She did none of this.
She did not give me copies of the final HUD papers and said nothing about the options and the pre-payment penalty.
She has cost my two sons and me a Christmas with no money, or food and my utilities are going to be turned off.
I was pressured and rushed in to closing the loan. She lied about the amount of money I was making, without my knowledge. I did not submit anything to her regarding my employment. At time of the loan, I had been in a wheelchair and was not working. She was aware that I had been working on my credit, and informed me that she would help to correct my credit, so we could apply for a loan with a better interest rate and a payment that I could afford. She did none of this.
She was supposed to be helping me and instead she helped herself to my equity in my home and cost me Interest rate that has cost me thousands of dollars due to my incorrect score. She caused me financial hardship and my creditworthiness and my home that has gone into foreclosure.
I currently owe a balance of $550,000 on my mortgage, and my house was recently appraised at $630,000. My credit score is rapidly dropping so I am having a hard time getting anyone to give me a loan.
I am sending this letter in hopes that there is someone out there who can help me. I am about to lose my home. Please, if you can help me, please respond either via telephone or e-mail. If you cannot help, please forward this to someone who can. I am running out of time.

Dear Nick:
I can’t advise you but I have to say this: As soon as you advertised that you have equity, the vultures will swarm around you to try to take it. I learned the extremely hard way as my story is detailed in the Silent Second story and I will soon be evicted as my home was stolen through an equity stripping scam and fraud. I too pleaded for help and did receive some nice responses but YOU are going to have to take action or you will lose your home. I hope you will contact a reputable attorney (if you can find one!) that handles foreclosures/landlord/tenant issues. Hopefully, they will recommend to either sue your former broker for misrepresentation and fraud or initial a Quiet Title action including fraud claims and ask the court for AN EMERGENCY STAY regarding the foreclosure. Try to speak to an attorney for a free consultation that may lead you into the right direction. DO NOT agree to a ‘short sale’ or sign a ‘Power of Attorney’. You may also want to explore bankruptcy options as a very last resort that could possibly save your home after exhausting all other means.
I trusted the wrong people because of how desperate losing your home will make you. And con-artists prey on that desperation. I do know now how we became severely victimized and targeted but I still will never understand the criminal mind. Being a good con-artist truly takes talent. And you would think to make a living of leaving people homeless and then being able to sleep at night would be an amazing feat but these criminals have no conscience or remorse. Just recently, I was completely devastated by somebody who I looked up to, thought was a good person and who promised to help me expose and combat the mortgage fraud in my case in which is not going to happen. People will still kick you when you are down. Please be careful when signing anything and if it sounds too good to be true, then believe that it is. I do hope you get some legitimate help.

I will be fileing action against your companys Equifax Experian TransUnon for unfair and deceptive business practices and misrepresentations of goods or your services regarding the condition of your obligation to investigate consumers claims
As a subscriber to your internet monitoring service, I was of the belief that not only would my subscription let me monitor all reports generated by your company, but as well, ease the bureaucracy of the dispute resolution process by enabling me to deal directly with your representatives via e-communication. This has not been the case, as I have also had to make numerous telephone calls, and spend money on postage which makes your service not worthy of the cost, excepting the ability to generate reports at will within the allotted time of the service agreement. But, in my case, for what? So I can waste more paper and time getting nothing for what I paid for?
In Jan 2006 I should have had only my house payment open and NO lates all of the outstanding accounts were paid in full on Oct 27 2005.
When I checked my credit report I had five accounts open one was due to fraud and a 30-day late and 38 Inquiries.
Below my credit reports, show you how long it took the credit bureaus to update or remove the inaccurate information, and how the errors reflected my score. All of the account should have stated paid in full, instead they remained open with outstanding balances. I have copies of letters from the creditors paid in full, and copies of checks from the Mortgage Company Again, these accounts were all paid in full in October 2005. Four, Open accounts that were paid off in October 2005. One fraud, account One 30 day late that was incorrect. 38 inquires never should have been on my credit report.

Also the credit bureaus have affected my credit report with out my help. Hey….I have been having a terrible time with AMC since 2003…and things are worse…my home is in foreclosure…and any day now, I will be asked to move. No one at AMC ever treated me as a person, or treated me farely. I wish all of you luck…and hope that your situations turn better.
AMC stated I had almost double the income then I did, didn’t provide me with any of the copies of my loan papers…for 1 year after I signed on with them…and I know that when I did receive the paper work, it had probably been altered…the rep from AMC that I worked with at the beginning, was alittle shady acting…I should have went with gut feelings then….cuz, when I began to have late fees, interest increases, no paper work, etc….he “no longer worked” for the company…and shortly thereafter, the company moved from the Flint MI location….and that is the beginning of the story 4 years ago….Now Feb, 07, I am waiting for them to post a note on my door…of a date I have to be out…
Legal fees and mediation fees…have but me over the edge…and I am burnt out…I have to begin again, and I will….with or without help to get AMC for their wrongful doings and practices.

In a similar class action lawsuit, I did recieve a check for .54 cents.
I hope that is not the case for the victims in this case.

WE,FINANCE ARE HOME WITH AMERIQUEST 4 YEARS AGO ITS BEEN NOTHING BUT,PURE HELL,AND CAN’T GET OUT FROM UNDER THEM.WE OWE MORE THAN WE BORROWED.AND OUR PAYMENT WENT FROM 1064.00 TO1740.00 .OUR SHOP BURN TO THE GROUND.WE RECIEVE 25000.00 IN INSURANCE TO RBUILD BACK AND THEY KEPT THE FUNDS.WE STILL HAVE NO SHOP.OUR LOAN IS STILL MORE THAN WHAT WE BORROWED.I GLAD SOMEONE FINALLY STEP IN TO GET SOMETHING DONE.MAYBE,THEY WON;T RIPP ANYMORE HARD WORKINGPEOPLE OFF. We refinanced with Ameriquest in 2004, we opted for the adjustable rate because we were told the rates would likely lower after the 2 year fixed rate expired. At closing we came to find out we had a prepayment penality for 3 years. It was too late to back out as we had no other options at the time. Hmm, that left 2 rate increases before we could get out of the loan. Now we are tryign to refinance only to find that the rate we can get is more then what we have now, but better then the next rate increase. If we don’t do it we are facing bancruptcy. How is this fair! Why are they allowed to still be in business and ruin the lvoes of honest hard working people who are just trying to get by. I get notice of a restituition payment for , guess how much? 300 and something dollars. Please tell me how to join a class action suit. This is just wrong.

This is so WILD! My husband and I have AMC too. However, when he refinanced our home two or three years ago, they only put his name on all of the paperwork. I happend to be looking online at our borough property information and our propterty is listed as having a QUITCLAIM deed insted of a Warranty deed. I guess I need to figure out what that’s all about.
Anyway, I always had a funny feeling about AMC and I cussed my husband to high heaven for getting involved with them. The first problem came when they would not auto draft our savings about for our mortgage payment they told us they could not draft a savings account but only a checking account. Our credit union is very small and although I provided them with all of the necessary information, they insisted that they could not do it unless we provided voided check. I was very nervous about this so I opened a checking account at a different bank and sent a voided check to them and every month I have part of my husbands retirement check go to that account to cover the payment. Well get this….on 4 different occasions, we have had to pay a late fees because they said the bank returned the payment. The last time this happend (last month), they called and told me that we were not allowed to do autopay because of the number of returned payments. I never knew this was happening because I always put a little extra in the account and never used it for anything else but the mortgage payment. Well come to find out, AMC had routinly posted the payment for the 1st day of the month even though we had a WRITTEN agreement for the payments to be drafted on the 5th. I selected the 5th of every month so that money from the Army would have time to make it to the original bank and then get transfered to the new bank. This would also leave a complete 10 days before the mortgage payment would be late. When I pointed this out to the VERY RUDE agent that called me, she soon realized that she was not dealing with someone that was just going to roll over and take it and had to apologize to me.
I came to the website looking for any similar problems. But now I see now that my problems are NOTHING compared to many of the previous entries. However, I still would like to find out about any class action suits. Because, this may be my only alternative to get the $200 in late fees back not to mention the bank fees.

Barbie, your amount may vary by state. I’m in Michigan and we just received a packedt from the Attorney Genneral’s office, because we had a prior loan with AMeriquest. The minimum payout in Michigan is $600 and checks are supposed to be mailed in the fall, to the eligible borrowers who agree to the settlement.
We were one of the lucky ones. We knew it was a crummy loan, but we were doing credit repair, and refinanced it with a conventional loan at our earliest opportunity.

It’s Ameriquest, the only company who did fraud ?? All credits cards or banks does the same I really would like see all these companies be under investigations too there it’s allot of people who are loosing their home or cars whit different mortgages or banks and nobody said noting!!!
I guess because they know the owner has money. I would like to see if the millions of dollar he will pay for penalties the customer will have some of it.

An old story but one that needs to be refreshed.
There was a television program recently about Ameriquest exposing how they did business. Most of us are aware of what happened there. I, as a mortgage broker, could not believe some of the stories I heard or the Settlement Statements people brought me after the fact seeking help and guidance. Talk about predatory lending, they were the masters of it.
But two things are important to know. One is that it was told on this news program that the founder of Ameriquest, shortly after the company closed was appointed by the U.S. Government to be an Ambassador to the Netherlands. A reward for a job BADLY well done? Maybe Ken Lay of Enron should have been made Secretary of the Treasury.
The other important item to know is that Ameriquest was primarily a telemarketing company with novice originators taught only what they needed to know to sell the program, period. Most of them had no knowledge of the mortgage industry. This is important to know as there are many other telemarketing and internet marketing mortgage companies out there doing the same thing. Their originators have no knowledge or training beyond what they need to know to “make the sale” for the limited products and programs that company offers.
I have always believed that PLANNING a mortgage is a one on one situation with that experienced, loan originator or even the novice originator that is with a company that has the talent and knowledge available to him to enable him to consult and advise a person properly. Getting a mortgage on the telephone or on line simply does not work FOR THE BORROWER. A mortgage is a complex instrument and cannot be purchased like a CD on ebay.
Bottom line, if you do business in this manner, when you get to the closing have the closing agent FULLY EXPLAIN every document you are asked to sign BEFORE YOU SIGN IT. In addition, know that you can walk away from the table if you don’t like what you see and hear. You are not expected to be an expert in the field, you do rely on the “experts” but you can JUST SAY NO! Get up and walk away and then seek legal advice.

Ameriquest hired Nations Title to do a Title search on my daughter’s property. Nations Title left to liens on the property do you know of anyone in a similar situation.

I got a mortgage loan with quick loans which ameriquest took right away it was a nightmare fro m hell. my payments was 1700.00 a month we where so far over our heads in debt. They knew that we could not aford that much our finances could not handle it so they told me to go the hall of records to start a business to say that I made more money with self employment with gardening… And I am still fighting . Now Downey Plattinum is a pain because they told me they could bring me out of forecloser and lower my payments by short sell and I should use a family member some one I trust . I cost me over 60000.00 tol sell my house . this was for one year and I could buy it back and they would give me cash out . they said I could stay in my house with lower payments . well my payments are now 2000.00 a month and no garnatee of being able to buy back from them because I got not one penny. Between them and the buyer theiy pocketed over 60000.00/ Is there any way get someone to help me and my husband to recover our losses.? We are both receiving socia security and just suffering from what they did to us

My husband and I refinanced our house in 2005 after our daughter was born premature. We had horrendous Dr. bills and AMC presented us with a “wonderful opportunity”. We were told to take out a loan for 130,000. As of today, we still owe 128,000. !! Our interest rate started at 9.5% and is due to go up on Oct. 1st. Citifinancial has taken over our loan (not by our choice) and we have had nothing but problems from the beginning. Our credit has gone down quite a bit since taking the loan from AMC. We want to refinance, but have no equity and bad credit!! Any suggestions or help?

Hi, I got a mortgage loan for an duplex i bought at the end of 2004. I am still barely holding on to a mortgage that is adjustable and was inflated from the start from AMC mortgage which got sold to ameriquest. I was advised to get an adjustable rate mortgage over a fixed (even thought I didnt intend to), the appraiser inflated the price so for the past few years it has been hard to sale with out taking a loss and the inspector passed my home with violations. Ameriquest sold my mortgage to Homeq mortgage which is no better. Now since 2005 my A PLUS credit has gotten alot worse trying to keep up with an adjusting mortgage and I have been offered no help from my mortgage servicer. I have been defrauded and I need help. I didnt know about this payout. Any suggestions?

I also had 2 ameriquest re-fi’s within the dates provided for the settlement offer. We lost our home when the loan terms doubled our mortgage cost, and we were NEVER contacted re the case. I never lost my job, etc. and was still at the same workplace as when I obtained my ameriquest mortgage. do I have any way to still sue ameriquest? They refused an offer of a loan purchase from my new lender and instead put the home to auction and made a bundle-to rich for my bidding to buy it back.
